Wills And Trusts ∙ Creating Your Estate Plan

An estate plan will help you avoid Probate Court (in the event of a conservatorship situation or post-death), establish revocable living trusts (as necessary) and assist in the transfer of your assets (either to a trust, or in joint tenancy with appropriate persons or with pay-on-death beneficiaries), and provide directions for your end-of-life health, financial and personal care. We will help you create a comprehensive estate plan that includes:

  • A will: The will is the foundational document in any comprehensive estate plan, directing the transfer of assets and other important matters. We help clients create wills that work with all aspects of their estate plans, including pourover wills, memorandums and other instruments for making small charitable gifts and gifts of inexpensive items of tangible personal property (which change over time) outside of creating new wills.
  • Trusts: A trust is a powerful tool for transferring assets in a way that can avoid probate for your surviving family, set up Special Needs Trusts for family members who are on government benefits, avoid tax penalties (to the extent possible). A trust can also allow you to retain a greater degree of control over the details of an asset transfer to the next generation.
  • Advance directives: We help clients create advance health care directives, which include health care powers of attorney and living wills. With these documents, you can name an agent to make health care decisions and communicate your end-of-lie health care wishes in the event that you become unable to communicate these choices. We will work with you to integrate your personal and religious beliefs into your estate plan and solve problems that arise regarding the Health Insurance Portability and Accountability Act (HIPAA).
  • Powers of attorney (POA): A financial POA appoints an agent to make financial decisions on your behalf in the event of incapacity. It can be used along with a trust to help you avoid a conservatorship of the estate, to the extent possible. Similarly, a personal care POA empowers your agent to make decisions to provide for your personal care — which can include hospital care, Hospice, Palliative Care, at-home care, nursing home care and other long-term care facilities — in the event that you cannot make or communicate these decisions yourself. Along with an advance health care directive, a personal care POA can help keep you avoid a conservatorship of the person.
